About one-third of the money President Trump has planned to use for building a border wall is off the table for the project following a federal judge's ruling on Tuesday.
District Court Judge David Briones, in El Paso, Texas, ruled that the Trump administration cannot legally reallocate $3.6 billion Congress had earmarked for military construction use. He issued a permanent injunction on the administration's use of the funds. The ruling comes after El Paso County and another party jointly sued the Trump administration to prevent construction of a steel barrier "border wall" through the community.
President Trump had previously issued an emergency declaration for what he terms a national security crisis on the U.S.-Mexico border. He then claimed the $3.6 billion for construction of the wall. The wall's completion has been one of the president's key goals.
An appeal by the Trump administration is expected.
