Ashli Babbitt's family moves to file lawsuit against U.S. Capitol Police, attorney says

The attorney representing the family of Ashli Babbitt said that the family will be filing a lawsuit against the U.S. Capitol Police.

Babbitt was killed during the riots at the U.S. Capitol in early January. The Department of Justice announced earlier this month that it would not be pursuing charges against the officer who shot Babbitt.

"We think the evidence is ample and would support criminal charges against the officer," said attorney Terry Roberts, who is representing Babbitt's family. "Clearly the officer had a required willfulness in this case. He clearly could see that she was not armed. She did not present an immediate threat to him and there was no legal justification to shooting her."
