A state supreme court justice ruled on Friday that Oneida County and the State Board of Elections may certify that Republican Claudia Tenney has defeated incumbent Democratic Rep. Anthony Brindisi by 109 votes in New York's 22nd congressional race.

Brindisi's lawyers are appealing the ruling, saying the certification should be paused until a hand count of votes.

After Tenney's victory, the Democrat's majority in the House shrinks to 221-212 over the Republican Party.
